Court to deliver decision tomorrow on Anwar's constitutional questions to federal court

THE Kuala Lumpur High Court will deliver its decision tomorrow on Datuk Seri Anwar Ibrahim's application to refer eight legal questions to the Federal Court, including whether the Prime Minister has immunity from a civil suit filed by Muhammad Yusoff Rawther.

Judge Roz Mawar Rozain set the date after hearing submissions from lawyer Alan Wong Teck Wei representing Anwar and Muhammad Rafique Rashid Ali on behalf of Muhammad Yusoff.

The legal question referred is related to a civil suit filed by Muhammad Yusoff four years ago over allegations that occurred seven years ago.

Through an application filed by law firm Messrs Zain Megat & Murad last week, Anwar requested that the Federal Court decide whether Articles 39, 40 and 43 of the Federal Constitution grant him conditional immunity from the suit.

In his supporting affidavit, Anwar stressed that the application was not made to delay the trial, but to ensure that the judicial process runs fairly and in accordance with the constitution.

According to reports in Harian Metro, he requested that the court consider whether the suit in question affects his ability to carry out executive duties and undermines the principle of separation of powers guaranteed by the Constitution.

The Prime Minister also wants the court to determine whether the proceedings in Muhammad Yusoff's suit violate his right to be treated equally before the law, as provided for in Article 8(1) of the Federal Constitution.

Anwar also requested the Federal Court to rule that the High Court must conduct an investigation to determine whether the suit is an abuse of process or a threat to public interest.

If so, the court must decide whether the suit should be suspended or quashed in order to maintain constitutional governance.

Anwar also requested the Federal Court to determine whether he, as the current Prime Minister, is entitled under Article 5(1) of the Constitution to protection from litigation of a strategic or politicised nature to affect his ability to govern the country.

In the suit filed by Muhammad Yusoff, he claimed that the incident allegedly occurred in 2018, before Anwar was appointed Prime Minister on November 24, 2022.

Following the allegations, Muhammad Yusoff, as the plaintiff, was accused of conspiring to bring down and ruin the defendant's political career, in addition to having an impact on his mental health due to criticism from various parties. - June 3, 2025
