A DIRECTOR of a construction and engineering company told the High Court today that part of the money he transferred to his brother's company was later donated to Bersatu.
The managing director and CEO of Sutracom Sdn Bhd (SSB), Shahrin Shamsuddin, 41, said SSB transferred RM13.8 million through nine transactions to Mamfor Sdn Bhd, a company owned by his brother, Shahradzi, between September 13, 2021 and November 14, 2022.
SSB had been awarded a RM605.2 million project to construct and upgrade Phase 3 of the Pulau Indah Ring Road in Klang under the government's Jana Wibawa programme.
The 15th prosecution witness in the case of Tan Sri Muhyiddin Yassin, who faces seven charges of abuse of position and money laundering related to the Jana Wibawa project, said the transfers were intended to pay for operating expenses and bad debts of Mamfor, Majulia Sdn Bhd, SSB and several other family-owned companies.
"I only knew that part of the money transferred to Mamfor Sdn Bhd was donated to Bersatu during family discussions after the Malaysian Anti-Corruption Commission (MACC) investigation.
"I am not sure what fraction of the money Shahradzi used to pay off the family company's debts and operating expenses and to donate to Bersatu.
"I trusted him (Shahradzi) to manage the settlement of the company's debts and operating expenses of my family company," he said.
When answering a question from Deputy Public Prosecutor Mahadi Abdul Jumaat during the main examination session, whether he gave permission for his brother Shahradzi to transfer the money to Bersatu, Shahrin replied, "No."
When asked whether at any time he had agreed to hand over the money to Bersatu as a donation, Shahrin gave the same answer.
When asked by Mahadi who managed the online money transfer, he replied that it was managed by him.
However, when cross-examined by lawyer Datuk Seri K Kumaraendran representing Muhyiddin, the witness agreed with the lawyer's suggestion that Muhyiddin had no connection with Mamfor and SSB and had no financial interest in the companies.
Meanwhile, Shahrin, who read out his witness statement, confirmed Muhyiddin's SSB letter titled 'Applying for Approval to Participate in the Pre-Qualification Tender for the Construction and Upgrading of Pulau Indah Ring Road Phase 3, Klang, Selangor by Design and Build, dated March 5, 2021.
He said that in a family discussion, his father suggested that they send a letter of interest or a letter of application for consideration to the Prime Minister's Office and relevant ministries to be involved in the Pulau Indah Phase 3, Klang project.
He said that the letter stated that SSB was interested in participating in the Pre-Qualification tender for the project involved; however, Shahrin explained that the letter was prepared and signed by his eldest brother.
He said that despite knowing about the letter, its preparation and submission were fully managed by his brother as part of their family's normal practice of applying for consideration for government projects.
The witness said that Majulia also submitted an application to Muhyiddin for approval to participate in the same project.
He said that SSB was aware that the project was listed and approved by the Economic Planning Unit (EPU), Prime Minister's Department and that it would be implemented in 2021 under the Twelfth Malaysia Plan (12MP) and would be supervised by the Ministry of Works (KKR).
He said that on March 26, 2021, SSB received an email from the Government Procurement Division (BPK) of the Malaysian Ministry of Finance informing them that the company had been listed for the company's Pre-Qualification Assessment for the implementation of government projects.
"I confirm that on 26 November 2021, SSB received a letter of invitation to tender for the Construction and Upgrading of the Pulau Indah Ring Road Phase 3 project to be implemented on a design and build basis.
"I confirm that on 8 October 2022, SSB received a letter of acceptance (SST) from the Public Works Department to implement the project amounting to RM605.2 million and the ownership of the site was set on 28 October 2022," he said.
