A FORMER unit trust and Private Retirement Scheme (PRS) consultant has claimed trial to two charges of carrying out securities-related activities without a licence, the Securities Commission Malaysia (SC) said.
Henry Tan Soong Yan, 35, was charged at the Ipoh Magistrate’s Court with offences under Sections 58(1) and 59(1) of the Capital Markets and Services Act 2007 (CMSA).
The charge under Section 58(1) alleges that he held himself out as carrying on a business of dealing in securities without a licence in February 2022.
The second charge, under Section 59(1), alleges that he held himself out as a representative of Public Bank Berhad in dealing in securities without a licence between January and September 2021.
Both alleged offences took place in Ipoh, Perak.
Henry pleaded not guilty to both charges before Magistrate Norizan binti Riduan and was granted bail of RM10,000 with one surety for each charge.
The court also ordered him to surrender his passport and report to the SC investigating officer once every two months while the cases are pending.
The case has been fixed for mention on Dec 16, 2026.
The SC was represented by prosecuting officers Keith Loo and Siti Sarah Kamaruzaman, while Henry was represented by Dexter Mah of Messrs KS Su & Mah.
The commission said dealing in securities was a regulated activity requiring a licence and urged investors to exercise caution before handing over money or committing to investment opportunities.
It also advised the public to use its Investment Checker to verify whether individuals or entities are authorised to offer, promote or sell capital market products and services in Malaysia. - October 9, 2026
