KUALA LUMPUR – After failing in its bid to strike out M. Indira Gandhi’s case in the high court, the government will challenge the decision at the Court of Appeal.

The high court on July 16 ordered a full trial for Indira Gandhi’s suit against the police and the government for alleged inaction in executing a warrant of committal to arrest her ex-husband for contempt.

Judge Mohd Nazlan Mohd Ghazali made the ruling during an online proceeding.

In dismissing the government’s bid to strike out Indira Gandhi’s suit, Nazlan said there were issues that needed to be ventilated at a full hearing.

The named defendants have filed a bid to strike out Indira Gandhi’s case pursuant to Order 18, Rule 19.

Nazlan refused their application, in essence, allowing the matter to proceed to trial and further ordering RM4,000 in costs to be paid to Indira Gandhi.

Now, the government, along with the three other defendants, have expressed dissatisfaction with Nazlan’s ruling and will challenge his decision at the appellate court.

The notice of appeal was filed yesterday.

Unless there is an order for a stay of proceedings, the trial at the high court is expected to resume on December 15.

In 2016, the Federal Court instructed the inspector-general of police to execute a warrant of committal against Indira Gandhi’s ex-husband Muhammad Riduan Abdullah over his failure to hand over custody of their youngest daughter, Prasana Diksa.

Riduan was found guilty of contempt for refusing to hand over custody of Prasana, who was taken away from her mother in 2010. – The Vibes, August 14, 2021
