KUALA LUMPUR – 1Malaysia Development Bhd (1MDB) and one of its subsidiaries have been granted an injunction by the high court here against fugitive businessman Low Taek Jho disposing or reducing any of his US$1.03 billion (RM4.3 billion) worth of assets in Malaysia.
Based on court documents, the injunction also applies to Low’s father Tan Sri Larry Low Hock Peng, who is barred from removing, disposing, or reducing the value of his US$401.5 million worth of assets in the country.
The decision was made by judge Hayatul Akmal Abdul Aziz in an online proceeding yesterday after allowing the mareva injunction application by 1MDB and Global Diversified Investment Company Limited (formerly 1MDB Global Investments Limited).
A mareva injunction is a court order that effectively freezes the assets of a defendant from being dissipated pending the outcome or completion of a legal action.
The current injunction also limits Jho and Larry from withdrawing more than RM20,000 a month per person as part of their living and legal expenses.
In the case of either of them needing to withdraw more than that amount, they will need to obtain a written approval from 1MDB and Global Diversified lawyers.
The order also states that Low and his father must make written disclosures to 1MDB and Global Diversified regarding their assets, valued at US$1.03 billion and US$401.5 million, respectively, either locally or abroad, either under their own name and whether in the sole or joint possession of another defendant.
They shall provide the value, location and all information of the asset and the information must be verified by an affidavit within 14 days after the order is served on the counsel representing the father and son.
If Low’s net assets in the country exceed US$1.03 billion, he can remove or dispose of them and the same applies to Larry, who can do the same for as long as the total assets is not less than US$401.5 million.
The order is in force until the court hears the inter-parte injunction on March 29.
A lawyer from the legal firm of Messrs Skrine representing 1MDB confirmed the court’s decision.
On May 7 last year, 1MDB and four subsidiaries Global Diversified, 1MDB Energy Holdings Limited, 1MDB Energy Limited and 1MDB Energy (Langat) Limited had filed a writ of summons seeking US$3.7837 billion from Low, Larry, Low’s mother Puan Sri Goh Gaik Ewe, his sister Low May Lin and brother Low Taek Szen and associate Eric Tan Kim Loong. – The Vibes, March 16, 2022
