KUALA LUMPUR – Among the matters set to be heard before the Court of Appeal, in the case of convicted clerk Sam Ke Ting who was charged over the deaths of eight teenagers on “basikal lajak”, are arguments over the initial prima facie finding against her by the Johor Baru High Court.
One of Sam’s lawyers Harvinderjit Singh told The Vibes that these were among the matters being sought in her appeal to challenge her conviction and sentence for alleged reckless driving that took place five years ago.
“The court was also informed that the appeal records, notes of proceedings and submissions which for the earlier appeal before the Johor Baru High Court ought to be part of the records before the appellate appeal as the issue of the prima facie case is also to be determined by the Court of Appeal.
“The court directed for a letter to be written to the Johor Baru High Court to request the same accordingly.”
He added that fellow counsel Muhammad Faizal Mokhtar will write to the Johor Baru court to obtain the required documents.
Harvinderjit said today’s virtual proceedings before registrar Mohd Khairi Haron also saw the prosecutors, represented by deputy public prosecutor Ng Siew Wee, confirming that they received Sam’s notice of appeal.
Case management is set for June 28.
Separately, Harvinderjit confirmed that Datuk Seri Gopal Sri Ram will appear as Sam’s lead counsel, with himself acting as co-counsel.
“Yes, I informed the court that Sri Ram is lead counsel and I will be assisting him,” he said, adding that Sri Ram did not attend today’s proceedings.
This comes after Sam was granted leave to appeal against her RM6,000 fine and six-year prison sentence meted out by Johor Baru High Court judge Datuk Abu Bakar Katar.
Her conviction stems from an incident on February 18, 2017 which took place along Jalan Lingkaran Dalam in Johor Baru where she crashed into a group of “basikal lajak” cyclists, killing eight teenagers. – The Vibes, May 11, 2022
