CLAIMS that the absence of a Chief Justice has paralysed the Malaysian judiciary are inaccurate and misleading, said Srikandi PKR chief Nurhidayah Che Rose, who reiterated that the courts continue to function in an orderly and uninterrupted manner.

In a statement issued on Tuesday, Nurhidayah said, “The Federal Court can still convene as long as it has a sufficient number of judges, as stipulated under Article 122(2) of the Federal Constitution.”

She added that Malaysia’s judicial structure—including the Court of Appeal, the High Courts and the Magistrates’ Courts—remains operational and unaffected by the current vacancy.

“The judiciary is not in crisis,” she said, calling for an end to speculation that could erode public confidence in the justice system.

“Speculative statements only serve to foster negative perceptions of the judiciary and may weaken public trust in the current system,” she warned.

Nurhidayah urged politicians and public figures, including Members of Parliament, to act responsibly when issuing public remarks on judicial matters.

“Never manipulate the issue of judicial appointments for narrow political interests. We must uphold the credibility of the judiciary, not damage it for personal agendas,” she said.

She also highlighted that the process of appointing a Chief Justice is clearly outlined under Article 122B of the Federal Constitution, which states that the appointment is made by the Yang di-Pertuan Agong on the advice of the Prime Minister, following a recommendation from the Judicial Appointments Commission (JAC).

“This process has long been practised transparently and in accordance with the spirit of the Constitution. It should not be politicised,” she added.

On a related note, Srikandi PKR extended its appreciation to all who participated in the March for Judicial Independence on Monday, including the party’s deputy president, Nurul Izzah Anwar.

“The march was peaceful and disciplined, reflecting the political maturity of Malaysians in expressing their views democratically,” Nurhidayah said.

She noted the presence of diverse groups, including women, youth and emerging leaders, which, she said, demonstrated the public’s growing awareness of democracy, the rule of law, and the integrity of national institutions. - July 15, 2025
