A POLICE constable attached to the Nibong Tebal station claimed trial on Thursday to a charge of cheating a woman by allegedly offering to resolve her brother’s police summonses for a reduced sum.

Awang Azizan Awang Jana, 44, entered a plea of not guilty when the charge was read before Judge Zulhazmi Abdullah at the Special Corruption Sessions Court in Butterworth on Jan 8.

According to the charge, Awang Azizan is accused of dishonestly deceiving a 49-year-old woman by offering to settle four police summonses issued to her younger brother, totalling RM850, in exchange for a payment of RM620.

The charge sheet states that he allegedly induced the woman to transfer RM620 into his personal bank account at a bank in Nibong Tebal on June 12, 2024, despite knowing that the representation was false.

The offence is framed under Section 417 of the Penal Code, which carries a maximum penalty of five years’ imprisonment, a fine, caning, or any combination thereof upon conviction.

Malaysian Anti-Corruption Commission deputy public prosecutor Noor Azura Zulkiflee sought bail of RM4,000, together with additional conditions that the accused report to the nearest MACC office and surrender his passport to the court pending the disposal of the case.

In mitigation, Awang Azizan, who was not represented by counsel, appealed for a lower bail on the grounds of his family responsibilities.

“I request that the bail be reduced as I have three family members to provide for, namely my wife, my child, and my sibling who is battling cancer,” he said.

Judge Zulhazmi fixed bail at RM3,000 with one surety and imposed the additional conditions requested by the prosecution.
