DATUK Seri Anwar Ibrahim successfully struck out the suit by former Minister in the Prime Minister's Department, P Waytha Moorthy, over his appointment as Prime Minister and Tambun Member of Parliament.

High Court Judge Alice Loke Yee Ching allowed this after dismissing Waytha Moorthy's original suit filed last year.

She said the court did not have jurisdiction to hear the suit as it should have been filed through an election petition.

The court then ordered Waytha Moorthy to pay costs of RM80,000 to Anwar.

Waytha Moorthy filed the suit on August 12, claiming that Anwar's appointment as the head of government on November 24, 2022, was unconstitutional, null and void, and questioned Anwar's eligibility to contest the 15th general election (GE15).

However, the argument was refuted by the defence representing Anwar, led by lawyer Ranjit Singh, who insisted that the issue of disqualification did not arise on the argument that Anwar had received a full pardon from the 15th Yang di-Pertuan Agong in 2018.

The pardon automatically clears all conviction records and restores the Prime Minister's right to contest in any election without any legal restrictions.

The Attorney General's Chambers (AGC), in its previous supporting argument, also stated that the plaintiff's action in using an originating summons was an incorrect procedure.

According to Section 38 of the Election Offences Act 1954, every challenge to the election results has a specific time period and filing method, which was not adhered to in this case.

Today's decision thus confirms Anwar's position as the legitimate Member of Parliament for Tambun and maintains the validity of his appointment as the 10th Prime Minister in accordance with the country's laws. – March 18, 2026
