THE Sessions Court today sentenced a former babysitter to five years in prison for negligence in the death of a three-month-old baby girl, Qaseh Aulia Faizul, three years ago.

Judge Dr Syahliza Warnoh ruled this after finding that the defence representing Mulyati Kalim, 54, who is also an Indonesian, failed to raise a reasonable doubt at the end of her defence case.

In addition to the prison sentence from the date of conviction, Mulyati was also imposed a good behaviour bond for three years with two local guarantors and a security of RM5,000.

She must also complete 120 hours of community service within six months.

The two additional sentences must be implemented after the accused completes his prison sentence.

During the proceedings, the defence team also applied to suspend the prison sentence, while the prosecution objected to the application.

The court rejected the defence application to suspend the sentence, and the accused was ordered to serve the sentence immediately.

According to the charge, Mulyati is alleged to have acted negligently as a person who had custody of Qaseh Aulia, causing the death of the baby.

The act was allegedly committed at a nursery in Kota Damansara, at 9.40 am, October 10, 2023.

The charge is under Section 31(1)(a) of the Children Act 2001, which carries a maximum fine of RM50,000 or imprisonment for up to 20 years or both, if convicted. – April 6, 2026
