A CONFRONTATION at a mobile phone shop six years ago has ended with a former worker being sentenced to 30 years in prison and 12 strokes of the cane for the death of a 43-year-old man.
Muar High Court judge Datuk Meor Hashimi Abdul Hamid convicted Lim Yew Lung, 32, after ruling that the prosecution had established its case beyond reasonable doubt following the conclusion of the defence case.
The judge said the court had carefully considered the written and oral submissions made by both sides, as well as the evidence and credibility of the defence witnesses.
“The court is satisfied that the defence put forward by the accused, SP2 and SP3 failed to raise any reasonable doubt against the prosecution’s case.
“The defence of the accused, SP2 and SP3 cannot be believed or accepted by this court.
“In fact, the defence of the accused and the evidence of SP2 and SP3 also failed to raise any reasonable doubt in this case.
“All the ingredients or elements of the charge were proven beyond reasonable doubt by the prosecution,” he said in delivering his judgment.
Meor Hashimi said the court was satisfied, after assessing the defence case in its entirety, that Lim was guilty of the offence.
“Therefore, the accused is found guilty and convicted, and the court sentences him to 30 years’ imprisonment commencing from the date of his arrest (January 29, 2020), as well as 12 strokes of the cane.
“The court orders that all exhibits in this case be handed over to the police for disposal after the expiry of the appeal period,” he said.
Deputy public prosecutor Othman Affan Ismail appeared for the prosecution, while Lim was represented by lawyer R K Balakrishnan.
Lim was charged with murdering Tsun Chin Kiang at a mobile phone equipment shop in Jalan Perwira 1, Taman Perwira, here, between 1.41am and 4.15am on January 29, 2020.
The charge was framed under Section 302 of the Penal Code, which provides for the death penalty or imprisonment of between 30 and 40 years, together with a minimum of 12 strokes of the cane, upon conviction.
According to the prosecution's case, Tsun was at the shop when a fight broke out between the two men.
Tsun sustained serious injuries during the confrontation and was rushed to Hospital Sultanah Aminah in Johor Bahru.
He died four days later while undergoing treatment. - August 26, 2026
