THE decision on returning Datuk Seri Mohd Shuhaily Mohd Zain to the Royal Malaysia Police after his tenure as Malaysian Border Control and Protection Agency (AKPS) director-general ends rests with the relevant ministry, not the Attorney-General's Chambers (AGC).
Attorney-General Tan Sri Mohd Dusuki Mokhtar said the matter fell under the ministry's administrative responsibilities, while the AGC's role was confined to providing legal advice when sought.
He said the AGC had yet to issue any formal opinion as the matter had not been referred to the department.
"So far, we have not provided an official opinion to the relevant parties because the matter has not been referred to the Attorney-General's Chambers," he was quoted as saying by BH today.
He was speaking after officiating and handing over the MADANI Adopted Village recreational facilities developed by the AGC in Kampung Kok Lanas near Kota Bharu today. - October 31, 2026
