KUALA LUMPUR – The Shah Alam High Court has granted leave for judicial review to Nigerian Simon Adavize Momoh.
His lawyer, V. Vemal Arason told The Vibes that the respondents represented by Liyana Muhammad Fuad did not object to the granting of leave.
“Immigration (Department) also gave a letter stating that Simon’s visit pass will be extended until the hearing of this case is over,” Vemal said in a brief WhatsApp conversation.
The leave application was granted by high court judge Wan Ahmad Farid.
On April 20, Simon filed a court action to challenge the Immigration Department’s orders to deport him.
He has been living in Malaysia for the past eight years with his Malaysian wife and two daughters.
Momoh was initially charged for drink driving and found guilty, upon which he was sentenced to one day imprisonment and fine on March 15
Expecting to be released after serving his sentence, he was then detained by immigration authorities and had his spousal visa revoked on April 9.
Vemal filed a habeas corpus application seeking Momoh’s release, which was heard on April 21, where the court ordered his release after 37 days in detention. – The Vibes, May 6, 2021
