DATUK Seri Najib Razak denied that funds of US$120 million, which ended up in his personal AmBank accounts, were from money misappropriated from SRC International Sdn Bhd or Retirement Fund Incorporated (KWAP).
The former prime minister and finance minister said his defence team would establish this fact during submissions.
SRC counsel Datuk Lim Chee Wee had again asked Najib at the Kuala Lumpur High Court for documentary evidence to show that the money was not from SRC or KWAP.
“My defence team had studied and analysed my documents and concluded that the money was not from KWAP or SRC. This is based on documents (the defence team has analysed). I don’t have them on me.
"Since the documents are not in my possession, I will leave it to my lawyers during submissions to show that the money is not from KWAP and SRC," said Najib.
Lim continued to press Najib further on whether he was able to show documentary proof that the money was not from KWAP or SRC.
Najib’s lawyer Muhammad Farhan Shafee then interjected and told Judge Datuk Ahmad Fairuz Zainol Abidin that it was not for Najib to show documents, it was for the plaintiff to present them to Najib.
The former Pekan MP was testifying in his defence in a civil suit brought against him by SRC, concerning a RM4 billion loan from KWAP, which was given to SRC in two tranches in the second half of 2011 and the first half of 2012.
The company claims that US$120 million eventually ended up in Najib’s bank accounts.
SRC, under its new management, filed the suit in May 2021, claiming that Najib committed a breach of trust and power abuse personally benefited from the company's funds and misappropriated the said funds.
It is also seeking a court declaration that Najib is responsible for the company's losses due to his breach of duties and trust and for Najib to pay back the RM42 million in losses that it has suffered.
Najib, 71, has been jailed since Aug 23, 2022, after he was convicted of misappropriating RM42 million in SRC funds. He was sentenced to 12 years in jail and fined RM210 million.
Following a petition for a royal pardon filed on Sept 2, 2022, the Federal Territories Pardons Board on Jan 29 halved Najib’s jail term to six years and reduced his fine to RM50 million. - October 9, 2024
