THE SEREMBAN Sessions Court today rejected the bail application of a family of five who were charged with kidnapping a 16-year-old girl last month.

Judge Datin Surita Budin made the decision after considering submissions from the prosecution and defence.

Earlier, Deputy Public Prosecutor Nurul Balkis Zunaidi said bail should not be offered because the offences committed by all the accused were non-bailable, except at the discretion of the court.

She explained that the sentence under Section 3(1) of the Kidnapping Act 1961, which is a minimum prison sentence of 30 years if convicted, showed the seriousness of the offence involved.

Lawyer, Low Carmen who represented all the accused then appealed to the court to grant bail, especially for the two female accused as it is provided for under Section 388 of the Criminal Procedure Code.

However, the prosecution said that the first accused, a woman, D. Sasveena, was the mastermind of the alleged criminal act and should not be granted bail.

Low Carmen explained that there was no evidence to show that the accused was the mastermind and to state this the prosecution had to prove reasonable doubt.

According to the charges, the first accused, Sasveena, 31; T. Boharaj, 32; Farhin Muhamad Ariffin, 23; and two siblings P. K. Koshenn Kumar, 21, and P. K. Siveeshinaa, 23, shared the common intention of kidnapping a 16-year-old teenage girl by abducting her for the purpose of demanding a ransom of RM2 million.

The offence was committed in front of a hair salon at Jalan S2 B10, Uptown Avenue Seremban 2 at about 5.45pm on April 10.

All of them were charged with committing an offence under Section 3(1) of the Kidnapping Act 1961 read together with Section 34 of the Penal Code.

Previously, the media reported that the criminals involved in the kidnapping case of the teenager hid the victim by putting her in a suitcase.

The action was aimed at avoiding detection by authorities and the public while moving the victim from the suspect's vehicle to a house where the victim was hidden.

On April 14, police shot dead a man in Bandar Bukit Tinggi, Klang, Selangor believed to be involved in the kidnapping case.

The court then set a date for the case to be mentioned again for the submission of documents on June 9. – May 14, 2025
