THE Speaker of the Perlis State Legislative Assembly, Rus'sele Eizan, has applied to strike out an originating summons brought by three former assemblymen who are challenging his declaration that their seats had fallen vacant.
Counsel for Rus'sele, Wan Rohimi Wan Daud, said the striking-out application was filed on Monday.
Speaking after a case management session conducted via Zoom before High Court Judge Datuk Mohamad Abazafree Mohd Abbas, Wan Rohimi said the court had fixed 25 March for the plaintiffs to file their reply to Rus'sele’s affidavit.
“The court has also set a deadline of 15 April 2026 for the defendant to file a reply.
“Subsequently, a proceeding (via) Zoom before the High Court judge to fix the hearing of the application and related directions has been scheduled for 16 April 2026,” he said in a brief statement to Bernama on Wednesday.
The three former state representatives — Mohd Ridzuan Hashim of Guar Sanji, Fakhrul Anwar Ismail of Bintong and Saad Seman of Chuping — filed the originating summons on 2 January, naming Rus'sele as the defendant.
They are seeking to challenge his declaration of extraordinary vacancies in their respective seats.
On 25 December last year, Rus'sele announced that the Chuping, Bintong and Guar Sanji seats had become vacant following the immediate cessation of the trio’s membership of PAS, in accordance with Clause (1)(a)(ii) of Article 50A of the Laws of the Constitution of the Government of Perlis.
The decision followed a statement issued on 24 December 2025 by PAS president Tan Sri Abdul Hadi Awang, who said the three assemblymen’s party memberships had ceased under Clause 76 and Clause 15A(1)(b) of the PAS Constitution (Amendment 2025).
