THE decision on whether former minister Nik Nazmi Nik Ahmad will face charges over an alleged khalwat (close proximity) offence now rests with the Selangor Syariah Prosecution Department after he gave a statement to the Selangor Islamic Religious Department (JAIS) today.
Nik Nazmi arrived at JAIS headquarters at about 9.15am and left at 1.30pm after his statement was recorded.
His Syariah lawyer, Muhammad Amirul Ashraf A. Ghani, said Nik Nazmi had attended to assist the investigation under Section 29 of the Syariah Criminal Offences (Selangor) Enactment 1995, which covers khalwat offences.
He said statements from the Bersama leader and the woman linked to the case were recorded separately.
“From the perspective of the investigation, we have cooperated. We will now wait to see whether charges will be brought,” he said.
Muhammad Amirul Ashraf said the decision on prosecution rested with the Selangor Syariah Prosecution Department.
Asked whether action would be taken against individuals allegedly involved in monitoring Nik Nazmi’s movements before circulating a related video, the lawyer said the matter would be raised at a later stage.
JAIS director Mohd Shahzihan Ahmad confirmed Nik Nazmi’s attendance at the department’s headquarters but declined to comment further.
Nik Nazmi had previously confirmed that he was one of two people detained by JAIS during an operation in Petaling Jaya on Oct 15. He reportedly denied that any immoral act had taken place and said he was prepared to cooperate with the legal process.
The investigation remains ongoing. Nik Nazmi has not been charged, and giving a statement does not establish that an offence has occurred. - October 27, 2026
