KUALA LUMPUR – A senior police officer detained under the Security Offences (Special Measures) Act 2012 (Sosma) over his alleged links to Geng Nicky was released on bail yesterday.
The matter was made known by lawyer Gobind Singh Deo, representing Baldev Singh Gurdial Singh, 36, when asked by the press today.
Federal counsel Muhammad Safuan Azhar said following his release, Baldev Singh will withdraw his application for a writ of habeas corpus (unlawful detention) that was filed on April 30.
“The court has set May 11 for case management regarding the withdrawal of the habeas corpus application before high court judge Mohamed Zaini Mazlan,” he told reporters after case management before deputy registrar Catherine Nicholas today.
According to his supporting affidavit filed along with the application, Baldev Singh said he was detained on April 26 in the capital for investigation under Section 130V of the Penal Code, for being a member of an organised criminal group, read together with Sosma.
He said he has never been involved in any case under Section 130V, and that his detention is outside the scope of that section or the provisions of Sosma, making it illegal and unconstitutional.
It was reported that the Shah Alam High Court was told another police officer detained under Sosma for links to the same group, namely Rahmat Fitri Abdullah, was released three days ago.
He has withdrawn his habeas corpus application, and the court quashed the bid as it was academic in nature.
On April 9, a total of 14 individuals, including two younger brothers of businessman Nicky Liow Soon Hee, were charged at the Petaling Jaya sessions court with involvement in the gang.
The 33-year-old Liow, who is founder of the Winner Dynasty Group, became a fugitive after 68 individuals alleged to be members of his criminal group were arrested under Op Pelican 3.0 from March 20 to 28. – Bernama, May 6, 2021
