PUTRAJAYA – The Court of Appeal has fixed October 5 to hear Datuk Seri Najib Razak’s appeal against a high court decision to strike out his suit against AMMB Holdings Bhd, AmBank and its former customer relations manager Joanna Yu Ging Ping.
Yu’s counsel Datuk Gurdial Singh Nijar confirmed to Bernama the appeal hearing date following case management today before senior assistant registrar K.B. Elena Hong Tze Lan.
The former prime minister is appealing against the high court decision allowing AmBank, AMMB Holdings and Yu’s application to strike out the suit he filed.
Najib filed the suit against the three on December 9, 2019, alleging mishandling of his bank accounts by disclosing transactions to fugitive businessman Low Taek Jho, better known as Jho Low.
On September 28 last year, high court judge Datuk Khadijah Idris held that the suit filed by Najib is scandalous, vexatious, frivolous and an abuse of the court process, as it is not aimed at seeking damages, but for collateral purposes to bolster his defence in his SRC International Sdn Bhd trial.
Yu was the 54th prosecution witness in the SRC International trial in which Najib was slapped with seven charges relating to the alleged misappropriation of RM42 million in the entity’s funds.
On July 28 last year, high court judge Mohd Nazlan Mohd Ghazali convicted and sentenced Najib to 12 years’ jail and fined him RM210 million in the SRC International case.
The Court of Appeal heard the Pekan MP’s appeal for 15 days beginning April, and reserved its judgment.
On his suit against AmBank, AMMB Holdings and Yu, Najib, in his statement of claim, contended that AmBank and Yu committed negligence when handling his bank accounts – ending in 694, 880, 898 and 906 – by disclosing them to Low.
Najib said AmBank, AMMB Holdings and Yu, without authorisation, disclosed his bank statements, debit and credit remittance transactions, and balance of funds for account 694 to Low as the third party. – Bernama, July 19, 2021
