THE Kelantan state government said it is committed to re-enacting the 16 provisions in the Syariah Criminal Offences Enactment (I) Kelantan 2019 annulled by the Federal Court last February.
According to reports in The New Straits Times, Menteri Besar Datuk Mohd Nassuruddin Daud said a motion was passed on this during the State Legislative Assembly in March.
"We cannot remain silent in the face of efforts by certain parties who, day by day, seek any opportunity to challenge anything related to the agenda of upholding Islamic principles, especially in the aspects of law and Syariah institutions," he said in his speech at the launching of a convention on strengthening Syariah institutions and laws in Kota Bahru today.
Present were Pas president Tan Sri Abdul Hadi Awang and Deputy Menteri Besar Datuk Dr Mohamed Fadzli Hassan.
He said all Muslims are obliged to obey, submit and devote themselves to Allah's commands.
"Our collective role at every level is to correct misunderstandings and dispel the doubts that arise so that the people in the state have a clear understanding of Islam," he said.
The Kelantan Assembly in March unanimously approved a motion to re-enact 16 provisions under the Kelantan Syariah Criminal Code (l) Enactment 2019 which were declared unconstitutional and invalid by the Federal Court in February.
The motion was read by Speaker Datuk Mohd Amar Nik Abdullah after it was tabled by PAS' Melor assemblyman Wan Rohimi Wan Daud.
It was assented to by all the reps, including the two from the opposition.
Mohd Amar said that, with the passing of the motion, the Kelantan state assembly called for the re-tabling of provisions that had been declared null and void.
In its decision on February 9, the Federal Court ruled the Kelantan state assembly had approved laws that it did not have the authority to make.
Chief Justice Tun Tengku Maimun Tuan Mat, who led a nine-member panel of judges, delivered the historic verdict following a challenge mounted by lawyer Nik Elin Zurina Nik Abdul Rashid and her daughter Tengku Yasmin Nastasha Abdul Rahman, both natives of Kelantan. – The Vibes, May 21, 2024.
