THE Klang magistrates’ court today sentenced a businessman to six years and 10 months in prison and fined him RM22,000 for assaulting, threatening, and insulting his bodyguards for fasting four years ago.
Magistrate Siti Zubaidah Mahat made the decision after finding that the defence, representing Chung Chee Yang, 47, failed to raise any reasonable doubt at the end of the defence case against all amended charges.
Siti Zubaidah also rejected a bid from Chung’s lawyer, Abdul Hakeem Aiman, for a stay of execution of the jail sentence, ruling that Chung must serve his sentence from the day of conviction.
The court also ordered the accused to serve an additional 21 months in prison if he failed to pay the fine.
For the charge of threatening under Section 506 of the Penal Code, the accused was sentenced to five years in prison and fined RM10,000, while for the second charge, which is uttering words that insult Islam under Section 298 of the same code, the accused was sentenced to one year in prison and fined RM10,000.
For the third charge under Section 323 of the Penal Code for voluntarily causing hurt, Chung received a 10-month prison sentence and a RM2,000 fine.
All the offences were committed outside a house in Bandar Bukit Tinggi, Klang, between 9.30 pm and 10.30 pm on April 13, 2021.
The court also rejected the accused's application to delay the imprisonment while awaiting an appeal in the High Court here.
Chung was taken to Kajang Prison after sentencing.
Chung’s lawyer, Abdul Hakeem Aiman, in his mitigation plea argued that his client had cooperated with the authorities and attended every proceeding without fail.
