THE Federal Court ordered Public Bank Bhd to pay RM90 million in damages to National Feedlot Corporation (NFCorp) and four others, including NFC chairman Datuk Seri Mohamad Salleh Ismail.
A three-member bench led by Chief Judge of Malaya Datuk Seri Hasnah Mohammed Hashim ordered the bank to pay RM30 million each in equitable, exemplary, and aggravated damages over an alleged breach of contract involving the protection of confidential bank account information.
The other members of the bench were Chief Judge of Sabah and Sarawak Tan Sri Abdul Rahman Sebli and Federal Court judge Datuk Abu Bakar Jais.
The court also ordered the bank to pay 2% interest on the total sum effective Wednesday, June 18, until the payment of damages is settled.
On May 26, the same panel dismissed an appeal by Public Bank in its final appeal in a RM560mil lawsuit brought by NFCorp over the confidentiality breach.
Hasnah added that Public Bank had not rebutted or challenged the financial reports or audited accounts of NFCorp during its appeal.
As such, the documents relied on by the appellants remained unchallenged, she said.
NFCorp’s lawyer Tan Sri Muhammad Shafee Abdullah told the bench previously that his clients were seeking RM560 million in damages: RM60 million in general damages, RM250 million in exemplary damages, and another RM250 million in aggravated damages. - June 18, 2025
