A GRANDFATHER was sentenced to 36 years in prison and 24 strokes of the cane by the Sessions Court in Sandakan today for raping his 14-year-old step-granddaughter, who subsequently gave birth to a baby boy. before Judge Zaini Fisher @ Fisal.

The accused was charged with two counts of rape.

For the first charge, he was found guilty of raping the victim at approximately 9am on October 13 last year at Kampung Seri Pemancar, which carries a penalty of 15 years in prison and 10 strokes of the cane under Section 376 (3) of the Penal Code.

The court imposed an additional sentence of three years in prison and two strokes of the cane under Section 16 (1) of the Sexual Offences Against Children Act 2017.

For the second charge, the accused was found guilty of raping the victim at approximately 10am on October 15 last year in a farm within the same village.

The court sentenced him to 15 years in prison and 10 strokes of the cane, with an additional three years in prison and two strokes of the cane.

Judge Zaini ordered both sentences to run concurrently from the date of the accused’s arrest and directed that he be referred to the Immigration Department for deportation to his home country after completing his sentence. The prosecution was handled by Deputy Public Prosecutor Muhammad Azizi Hamil.

According to the charge sheet, the victim and her two siblings lived with their grandmother and the accused, as their parents were divorced. The accused was arrested on July 23 at Batu 36 after the victim’s biological mother filed a police report, alleging her daughter had given birth to a baby as a result of being raped by the accused. - August 25, 2025
