THE case mention of a teenage boy who is accused of killing a 16-year-old female student at a school in Bandar Utama, Petaling Jaya was postponed after the Magistrate's Court was informed that the accused needs to undergo a mental assessment.
Magistrate Amira Sariaty Zainal set December 19 as the date for the re-mention of the case.
Lawyer for the accused, Kitson Foong, said the psychiatric assessment report was important to ensure that his client was fit to plead guilty and then go through the trial process.
"The court today has taken into account Section 342 of the Criminal Procedure Code, which allows for such an application and extended it to a date in the hope that the report will be ready to be shown in court.
"An assessment needs to be made of the client's fitness to plead guilty and be tried later. Apart from that, it is also important because the mental state of the accused must be taken into account when charged with committing an offence.
“We see this postponement as a commitment by the court to ensure that the legal process is carried out thoroughly and fairly, especially involving a juvenile,” he said when met by the media at the court premises.
The prosecution was conducted by Deputy Public Prosecutor, Syed Ahmed Khabir Abdul Rahman.
Commenting on the condition of the accused who is currently receiving treatment at Hospital Bahagia, Foong said his client is understood to be in good physical condition and is receiving full treatment.
At the first mention previously, the charge was read out in Mandarin before Magistrate Amira Sariaty Zainal through closed proceedings since the accused is a juvenile.
No plea was recorded because the offence of murder under Section 302 of the Penal Code can only be tried in the High Court.
On October 14, the 14-year-old was charged with murdering a 16-year-old female student at a national secondary school in Bandar Utama, Petaling Jaya.
The accused is charged with murdering the victim in the female student's toilet between 9.20am and 9.35am. - November 21, 2025
