A 27-year-old marketing employee has denied a charge of reckless driving that allegedly caused the deaths of a young father and his two small children in a collision on the Kulim–Mahang road
A MARKETING employee at a vehicle workshop was charged in the Magistrates’ Court here on Monday with reckless driving resulting in the deaths of a man and his two young children in a road crash on Jan 18.
The accused, Mohamad Aqlan Marwan Mohamad Toha, 27, pleaded not guilty and claimed trial after the charge was read before Magistrate Nur Hamizah Mat Shah.
According to the charge, Mohamad Aqlan was alleged to have driven a Proton S70 in a reckless manner, colliding with a Perodua Viva and causing the deaths of Muhammad Syazwan Mohd Suroddin, 25, and his two sons, Muhammad Aqeel Afnan, aged four, and Muhammad Affan Mikhael, aged two.
The incident was said to have occurred at about 5pm along Jalan Kulim–Mahang here on Jan 18.
The accused was charged under Section 41(1) of the Road Transport Act 1987, which carries a maximum penalty of 10 years’ imprisonment and a fine of up to RM50,000 upon conviction.
The prosecution was conducted by deputy public prosecutor Wan Nursalwati Wan Kamarul Ariffin, while the accused was represented by National Legal Aid Foundation counsel Datuk Kamal Pasha Jamal.
The prosecution sought bail of RM25,000, but the defence applied for a reduction, citing the accused’s monthly income of RM3,000 and his responsibility to support an unemployed wife and a two-year-old child.
The court allowed bail of RM8,000 with one surety and fixed March 3 for case mention for document submission. The magistrate also ordered the suspension of the accused’s driving licence and directed him to surrender his international passport to the court pending the conclusion of the trial.
The accused subsequently posted bail at the Kulim Court Complex. - January 26, 2026
