A SUSPENDED police corporal pleaded not guilty in the Sessions Court in Ampang today to two charges of sexually assaulting his 11-year-old daughter.
The 35-year-old father of four entered the pleas after the charges were read before Judge Norshila Kamarudin.
According to the charges, the accused, as the child's father and a person in a position of trust, allegedly committed physical sexual assault against his daughter, then aged 11 years and 10 months, for sexual purposes.
The offences were allegedly committed at a house in Kuala Kubu Bharu, Rawang, between 9pm and 10pm on May 21, and at about 2pm on May 22.
He was charged under Section 14(b) of the Sexual Offences Against Children Act 2017, punishable under Section 14 of the same Act and read together with Section 16(1).
The offences carry a maximum prison sentence of 20 years and whipping upon conviction, while Section 16(1) provides for imprisonment of up to five years and a minimum of two strokes of the cane.
Deputy Public Prosecutor Muhammad Hairuliqram Hairuddin objected to bail, informing the court that the accused was already facing a separate rape charge involving his eldest daughter, who was 18 at the time of the alleged offence.
He told the court that after being granted bail in the earlier case before the Kuala Kubu Bharu court, the victim's family lodged a complaint alleging that the accused had harassed the teenager.
"I therefore ask the court not to grant bail as there are concerns that he may attempt to approach the victims," he said.
Defence counsel Muhammad Azim Hilmi Aziz argued that the current charges were unrelated to the earlier case and said his client no longer lived with either of the alleged victims.
He also urged the court to grant bail on medical grounds, saying the accused was undergoing psychiatric treatment at Hospital Bahagia Ulu Kinta in Perak and required prescribed medication that could not be taken in prison due to its side effects.
The prosecution suggested that the accused could instead be placed at the psychiatric hospital to facilitate treatment, but the defence said its client was not seeking such an order.
The defence further informed the court that the accused's mother was prepared to post bail and ensure his attendance at future proceedings.
However, after noting that the mother resided in Ipoh while the accused lived in Kuala Kubu Bharu, Judge Norshila refused bail.
The judge also cited complaints from the victims' family alleging harassment and said bail would only be reconsidered if the defence produced a suitable surety capable of ensuring the accused's attendance in court and compliance with conditions prohibiting any contact with the victims.
The court fixed Aug 26 for the next case management and the submission of documents relating to a proposed surety, if any. - July 22, 2026
