A 40-YEAR-OLD man has been charged at the Magistrates’ Court here with murdering his 18-month-old son, three years after the toddler died in an incident that was initially investigated as a different category of case.
The accused, identified as G Thevendhiran, nodded in understanding after the murder charge was read before Magistrate Nurzihan Abdul Rehman on Wednesday.
However, no plea was recorded as the offence falls under the jurisdiction of the High Court.
The accused, who previously worked in Singapore, was charged with murdering the baby boy at a condominium in Bandar Baru Permas Jaya between 8.30am and 10am on September 12, 2023.
The charge was framed under Section 302 of the Penal Code, which carries the death penalty or imprisonment of between 30 and 40 years, and, if the death penalty is not imposed, mandatory whipping of not less than 12 strokes upon conviction.
Deputy Public Prosecutor Nor Deana Aqila Aliman led the prosecution, while Thevendhiran was unrepresented.
The court denied bail and fixed October 1 for the submission of DNA, pathology and forensic reports.
Separately, at another court, Thevendhiran was fined RM3,000 and sentenced to one month’s imprisonment after pleading guilty to possessing obscene material stored in his mobile phone.
Magistrate A Shaarmini ordered the jail term if he failed to pay the fine.
The accused was charged with committing the offence at the same condominium car park at about 1pm on July 18 under Section 29(a) of the Penal Code, punishable under Section 292 of the same law.
Deputy Public Prosecutor Anis Shafeeqah Mohd Shariffudin conducted the prosecution, while the accused was represented by National Legal Aid Foundation lawyer Noor Asyikin Shafiqah Atham Malik.
Earlier, police reclassified the toddler’s death as a murder case following the arrest of his biological father, who was identified as the main suspect on July 18.
The child was confirmed dead after being brought by his father to Hospital Sultan Ismail (HSI) on September 13, 2023.
Medical examinations at the time found bruising around the child’s waist area, abdominal swelling and swelling around the anus, prompting further investigation into the circumstances surrounding his death. - July 29, 2026
