DATUK Seri Najib Razak can still serve the remainder of his sentence in the SRC International Sdn Bhd case under house arrest despite the High Court’s rejection of his application to stay his 1Malaysia Development Bhd (1MDB) sentence, his lawyer said.

Tan Sri Muhammad Shafee Abdullah said Najib had received the royal order, together with an appendix setting out the terms and conditions of the house arrest arrangement.

He confirmed that Najib would serve the remainder of his SRC sentence at his Langgak Duta residence with his family, but said the former prime minister had been instructed by prison authorities not to disclose the contents of the order.

“The location has been confirmed as Langgak Duta. He can live there with his family,” Shafee told reporters at the Kuala Lumpur Court Complex today.

He said the High Court’s decision on Wednesday to reject Najib’s application to stay his 15-year prison sentence and RM11.4 billion fine in the 1MDB case did not affect the royal order covering his SRC sentence.

Najib had applied for a stay pending his appeal against the conviction and sentence in the 1MDB case.

Shafee described the ruling as disappointing and said the defence would file a fresh application for a stay directly at the Court of Appeal, rather than pursue the usual process of appealing against the High Court’s decision.

He said the move was intended to avoid further delays.

Shafee added that Najib could serve the remainder of his six-year SRC sentence under house arrest until Aug 23, 2028, subject to payment of the RM50 million fine.

The lawyer said prison authorities had barred Najib from disclosing the order’s contents to prevent speculation over the terms and implementation of the arrangement.

Last week, Prime Minister’s Department Legal Affairs Division director-general Zamri Misman said the Prisons Department had provided further clarification to Najib on the house arrest mechanism.

On Sept 19, Attorney-General Tan Sri Mohd Dusuki Mokhtar said the department was expected to prepare standard operating procedures covering visits, security and monitoring of Najib’s movements.

On Sept 18, Yang di-Pertuan Agong Sultan Ibrahim granted Najib a conditional pardon allowing him to serve the remainder of his SRC sentence under house arrest until Aug 23, 2028, subject to payment of the RM50 million fine. The decision was made at the 64th meeting of the Federal Territories Pardons Board.

Najib had been serving his sentence at Kajang Prison after his conviction in the SRC International case was upheld by the Court of Appeal and the Federal Court. – October 15, 2026
