KUALA LUMPUR – The government has given an assurance that police will use their discretion when issuing the maximum fine of RM10,000 to movement control order (MCO) violators.

Senior Minister Datuk Seri Ismail Sabri Yaakob told a press conference today that the maximum amount is only for repeat and serious offenders, and not meant to victimise the public.

“Tan Sri IGP (Inspector-General of Police Tan Sri Abdul Hamid Bador) has also stated that the RM10,000 compound will not be issued to those who don’t wear a mask or don’t observe physical distancing.

“The public must have confidence that police will use their discretion, and won’t victimise the people.”

Earlier, the Attorney-General’s Chambers portal said anyone found flouting MCO rules face a fine of up to RM10,000 effective March 11.

A compound of up to RM50,000 will be issued to companies committing the same offences.

The fine is gazetted under the Emergency Ordinance (Prevention and Control of Infectious Diseases) (Amendment) 2021.

Previously, under Regulation 3(1) of the Prevention and Control of Infectious Diseases (Measures Within Infected Local Areas) Regulations 2020, offenders can be fined not more than RM1,000, or jailed not more than six months, or both, upon conviction.

Various parties have voiced concern about the increased fine amount, saying it will add to the people’s financial burden amid the Covid-19 pandemic.

Ismail Sabri said owners of and visitors to entertainment centres who continue to flout the regulations will also be issued the RM10,000 fine.

This is because such outlets are still barred from operating, he said.

He added that individuals who have been issued compounds can appeal for a reduced amount, with the decision to be made on the discretion of district health officers. – Bernama, March 2, 2021
