THE Magistrate's Court sentenced a man to 34 months' imprisonment and six strokes of the cane for his despicable act of molesting, recording and storing pornographic photos of his biological sister, who is also disabled (OKU).

Magistrate Arun Noval Dass imposed the sentence on the accused, who is also unemployed, aged 28, after he pleaded guilty to all three charges.

According to the first and second charges, the accused, who is still single, was charged with molesting his 35-year-old biological sister at a house near Parit Raja, Batu Pahat, at 8.41 and 9.10 pm, on February 20.

He was charged under Section 354 of the Penal Code, which provides for imprisonment of up to 10 years or a fine or caning or any two of these penalties.

For the third charge, the accused is charged with storing the victim's pornographic material on his mobile phone, with all incidents occurring on the same date, time and location.

The offence was committed under Section 292 of the Penal Code, which carries a prison sentence of up to three years or a fine or both if convicted.

Based on the facts of the case, while at his house, one of his sisters saw the accused doing something to the victim.

The victim was not only disabled but also had to wear disposable diapers. At the time of the incident, there were several other family members in the house.

Acting on a report, the police arrested the accused at 1.05 am, February 21, and an examination of the mobile phone also found pornographic videos and photos of the victim that were recorded.

The prosecution was conducted by Deputy Public Prosecutor Firdaus Ruslan while the accused was represented by lawyer Tan Song Yang from the National Legal Aid Foundation (YBGK).

The court then sentenced him to 12 months in prison and three strokes of the cane for each of the first and second charges, and 10 months in prison for the third charge.

All prison sentences will run concurrently, with effect from the date of arrest on February 21, except for the whipping, which will be carried out separately. – February 25, 2026
