Magistrate Chia Huey Ting handed down the sentence to Tan Chee Gang, 37, and ordered the accused to be jailed for six months if he failed to pay the fine.

According to the first charge, the accused was charged with committing an insulting act by making obscene gestures to a car driver with the intention of causing fear.

The charge was brought under Section 507B of the Penal Code, which provides for a maximum prison sentence of three years or a fine or both, if convicted.

For the second charge, he was charged with driving a car in a condition that could endanger other road users and was charged under Section 42(1) of the Road Transport Act 1987 (Amendment) 1999, which provides for imprisonment of not more than five years, a maximum fine of RM15,000 and disqualification from holding or obtaining a driving licence for a maximum of five years.

Both offences were allegedly committed at Jalan Tun Dr Awang here, at 11.27 am, May 28.

Prosecution was conducted by Deputy Public Prosecutor, Ikmal Affandi Zulkifli, while the accused was represented by Yayasan Bantuan Guaman Kerajaan (YBGK) lawyer Chester.

Huey Ting set a fine of RM3,000 for the first offence, a one-day jail term, a fine of RM5,000, and a disqualification of the driving licence for five years for the second offence, besides ordering the accused to be jailed for six months if he fails to pay both fines.

On May 30, police arrested the man to assist in investigations into an incident of criminal threats and making obscene gestures, the video of which went viral on social media. – June 4, 2026
