TEN former Negri Sembilan executive council members have filed an originating summons against the Negeri Sembilan State Secretary and the Negeri Sembilan State Government at the High Court to challenge the decision to revoke their appointments.

The 10 plaintiffs are Datuk Mohd Faizal Ramli, Datuk Zaifulbahri Idris, Datuk Mustapha Nagoor, Siow Kong Choon, Siti Nur Umairah Hashim, Datuk Mohd Asna Amin, Datuk Mohd Razi Mohd Ali, Suhaimizan Bizar, Mohd Fairuz Mohd Isa and Datuk Razali Abu Samah.

They filed the lawsuit on Monday through the law firm of Hafarizam Wan & Aisha Mubarak.

Based on the documents obtained, all the plaintiffs are seeking a court declaration that the revocation is null, void, and of no effect.

They are questioning whether an appointment to the State Executive Council (Exco) can be revoked through the unilateral withdrawal of the Yang di-Pertuan Besar's royal assent, without the advice of the Menteri Besar.

“We seek a declaration that the revocation of the appointment, as gazetted in the Negeri Sembilan State Government Gazette (NS PU 18) dated September 24, be declared null and void.

“The plaintiffs also claim general, exemplary, and aggravated damages, in addition to interest and costs,” the document stated.

The plaintiffs also seek a court ruling on the constitutional question regarding the power to revoke the appointment of State Executive Council (Exco) members.

According to the document, the issue raised is whether an Exco member can be dismissed solely through the withdrawal of the Yang di-Pertuan Besar’s assent—without the advice of the Menteri Besar—based on the proper interpretation of the Laws of the Constitution of Negeri Sembilan 1959.

They also questioned whether the provision stating that an Exco member holds office at the pleasure of the Ruler grants the Yang di-Pertuan Besar unfettered power to unilaterally revoke the appointment.

The case is scheduled for an online hearing via Zoom before Judge Roz Mawar Rozain on October 21.

Meanwhile, lawyer Datuk Mohd Hafarizam Harun, representing all the assemblymen involved, confirmed the matter.

He stated that the application is supported by 10 affidavits from all Exco members, as well as an additional affidavit from the Menteri Besar.

On September 20, the appointments of the 10 Negeri Sembilan Exco members were revoked with immediate effect.

The revocation received the assent of the Yang di-Pertuan Besar of Negeri Sembilan, Tuanku Muhriz Tuanku Munawir, pursuant to Article XXXVIII(5) of the Laws of the Constitution of Negeri Sembilan 1959.

This matter was stated in the Negeri Sembilan State Government Gazette, NS PU 18, published as a Legislative Supplement, Volume 79, No. 39.

The gazette stated that all 10 Executive Council members concerned had taken and signed the oath of office and the pledge of loyalty before Tuanku Muhriz on August 7, prior to assuming their positions as state Executive Council members. – October 7, 2026
