A FORMER police officer has asked the Attorney-General to reopen an alleged assault case involving Malaysian Border Control and Protection Agency (MCBA) director-general Datuk Seri Mohd Shuhaily Mohd Zain, whose separate trial over an alleged assault on two policemen at Kuala Lumpur International Airport (KLIA) is pending.
Lawyers Kamal Hisham Ja’afar and Muhammad Nor Tamrin said their client, Saifuddin Abdul Kader, lodged a police report against Mohd Shuhaily on Nov 19, 2015, when the latter was Hilir Perak district police chief.
They alleged that no action had been taken against Mohd Shuhaily over the report.
“We received information from a member of the public about a complainant who alleged that he was assaulted by Shuhaily in 2015.
“Although a police report was lodged, no action has been taken against Shuhaily to this day,” the lawyers said in a statement.
According to the report, Saifuddin alleged that the incident occurred at about 8.30am on Nov 17, 2015, while he was manning a guard post at the Hilir Perak district police headquarters.
He claimed Mohd Shuhaily reprimanded him for failing to salute, repeatedly scolded him in front of other officers and punched his left wrist once during the confrontation.
Saifuddin also alleged that Mohd Shuhaily threatened to transfer him to Sabah or Sarawak and subject him to disciplinary action.
The lawyers said their client subsequently faced difficulties in his career and was eventually dismissed from the police force.
They said Saifuddin now believed there was an opportunity to seek justice following the Attorney-General’s decision to charge Mohd Shuhaily in a separate case involving two policemen at KLIA.
“Having seen the principle of equality before the law, without discrimination, demonstrated by the Attorney-General in bringing charges against Shuhaily, Saifuddin believes he still has an opportunity to obtain justice under the current administration,” they said.
“We respectfully request that this case be reviewed and reconsidered to ensure that the rule of law continues to be upheld without discrimination.”
On Oct 21, Mohd Shuhaily pleaded not guilty at the Sepang Magistrates’ Court to two charges of voluntarily causing hurt to two police officers at KLIA on Sept 28.
The charges were brought under Section 323 of the Penal Code, which provides for a maximum jail term of one year, a fine of up to RM2,000, or both, upon conviction.
The 2015 allegations against Mohd Shuhaily remain claims made by Saifuddin and have not been established in court. - October 28, 2026
