THE return of former Malaysian Border Control and Protection Agency (AKPS) director-general Mohd Shuhaily Mohd Zain to the police force is pending the Yang di-Pertuan Agong’s consent to shorten his appointment, Inspector-General of Police Mohd Khalid Ismail said.

He said the police had yet to decide on the senior officer’s next assignment as the process to end his secondment to AKPS was still awaiting royal approval.

Mohd Khalid said Mohd Shuhaily’s appointment as AKPS director-general had been made by the King, and any move to shorten his tenure therefore required His Majesty’s consent.

“Until that consent is given, I am still waiting and cannot confirm his next assignment. But he will certainly return to the police force because he is a police officer,” he told reporters after the Malaysian Ex-Police Association’s appreciation dinner at a hotel in Kuala Lumpur last night.

He said any subsequent action would be considered after Mohd Shuhaily formally returned to the Royal Malaysia Police (PDRM), in accordance with the relevant Public Services Commission and Police Force Commission regulations.

“There is still no decision. Once he returns to PDRM, we will look at the next course of action based on the applicable regulations,” he said.

Home Minister Saifuddin Nasution Ismail confirmed on Thursday that the Home Ministry had decided to end Mohd Shuhaily’s secondment to AKPS, with the police to determine his next posting.

The decision to terminate the secondment was made last week, he said.

Mohd Khalid had earlier said the matter was being reviewed and referred to the Attorney-General’s Chambers before a decision was submitted to the King. It had also been raised with the Police Force Commission to determine the appropriate action under service regulations.

Mohd Shuhaily was appointed AKPS director-general for a two-year term from July 1, 2025, to June 30, 2027. Before that, he was director of the Bukit Aman Criminal Investigation Department, a post he held from August 2023.

On Oct 21, he pleaded not guilty at the Sepang Magistrate’s Court to two charges of voluntarily causing hurt to two police personnel in an incident at Kuala Lumpur International Airport Terminal 1 on Sept 28.

The charges were brought under Section 323 of the Penal Code, which carries a maximum jail term of one year, a fine of up to RM2,000, or both, upon conviction. - October 31, 2026
