TAWAU – Two shopworkers have been sentenced to death after the high court found them guilty of possessing 70.9kg of drugs, two years ago.
The accused, Tan Teng Siong, 42, and Tay Thong Keng, 34, were charged with committing the offence at Jalan Haji Karim, near Tawau Court at 12.30pm on November 9, 2018.
Based on the charges read, they, and another accused, Tan Teng Sang, 38, were found guilty of possessing methamphetamine behind Tawau Court.
They were charged under Section 39B (1)(a) of the Dangerous Drugs Act 1953; an offence punishable under Section 38B (2) of the same Act.
Judge Dr Lim Hock Leng said that the defence failed to raise a reasonable doubt for the prosecution’s case.
The prosecutor, on the other hand, successfully presented proof that the two accused had the common intention of smuggling drugs. Following which, the court found them guilty and sentenced them to death by hanging.
However, Teng Sang (the third accused) was freed as the defence counsel had successfully raised a reasonable doubt.
The prosecution was led by deputy public prosecutor Mohammed Ali Imran, while counsels for the accused were Dominic Chew, Luke Ressa Balang and Ram Singh Harban Singh. – The Vibes, November 26, 2021
