Legislation to maintain Malaysia's competitive edge on the global stage - March 18, 2025

THE introduction of the Jurisdictional Immunities of Foreign States Act 2024 is expected to strengthen and promote diplomatic relations between Malaysia and other nations, according to Prime Minister Datuk Seri Anwar Ibrahim.

In a post on Facebook, the Prime Minister highlighted that the enforcement of the Act on 30th August 2024 aligns with the principles of public international law regarding state immunity.

He emphasised the importance of the legislation in maintaining Malaysia's competitive edge on the global stage, as well as its role in boosting the country's economy and protecting national security.

The Act, he noted, also serves to enhance investor confidence in Malaysia’s legal framework, providing a secure environment for business operations.

“This is a crucial step in ensuring Malaysia's continued growth and stability. The Act demonstrates our commitment to international norms, as it formally adopts customary international law, which ensures that a state is immune from legal actions and proceedings in foreign courts,” said Anwar.

Earlier, the Prime Minister chaired the inaugural Foreign State Immunity Council meeting for 2025, following the enactment of the Jurisdictional Immunities of Foreign States Act 2024 (Act 853).

He added that the meeting provided an opportunity to familiarise the council with its functions, powers, and membership, while also addressing the procedures for requesting immunity under the newly established Act. - March 18, 2025
