THE Kuala Lumpur High Court today dismissed a legal challenge brought by 3,210 Malaysian Armed Forces (ATM) veterans against the federal government over alleged failure to implement pension adjustments for those who retired before 1 January 2013.
Justice Raja Ahmad Mohzanuddin Shah ruled that the government had acted in accordance with established procedures and found no constitutional breach in its handling of the pension realignment.
In his judgment, the judge held that the plaintiffs had failed to demonstrate that the government had violated the Federal Constitution.
“This is because all necessary adjustments have already been implemented by the government,” the court concluded.
The veterans, who served in various ranks, had filed the originating summons on 11 April 2025. They sought a declaration that the government’s alleged failure to update their pensions constituted a violation of the Federal Constitution, read together with Section 187 of the Armed Forces Act 1972.
They argued that the lack of adjustment created a significant disparity in pension amounts between those who retired before and after the 2013 benchmark.
Lead counsel Datuk Abdul Shukor Ahmad stated that the legal team intends to file an appeal against the decision in the near future. - October 16, 2025
