Prosecution continues: AGC denies nullifying Najib’s SRC trial

KUALA LUMPUR – The Attorney-General’s Chambers (AGC) has rubbished allegations that it nullified Datuk Seri Najib Razak’s SRC International Sdn Bhd trial.

The AGC described the claim as fake and untrue in a brief statement today. 

It added that it will continue to act as the public prosecutor in the corruption case involving the former prime minister when the matter is heard at the apex court next month. 

“The Federal Court has set August 15, 2022 for the hearing of the appeal of the SRC case involving Najib, where we will be present as respondent and public prosecutor. 

“The department will continue with the appeal of the case and will wait for the verdict of the apex court.”

The AGC also uploaded a poster on Twitter that had supposedly made the allegation it was referring to in its statement. 

The poster portrayed an image of AG Tan Sri Idrus Harun with an accompanying message that claims the AGC has decided to nullify the previous SRC trial due to proceedings error. 

“However, we were informed that the AG has yet to make an announcement pending advice on its political impact. Such delay will only tarnish the justice system.

“More shocking is that Prime Minister Datuk Seri Ismail Sabri Yaakob and Tan Sri Muhyiddin Yassin have been informed (of the matter). Why do we need their confirmation?” the poster read. 

Umno-linked portal MyKMU.net had earlier today run an article based on this information before it was taken down. 

On June 7, Najib, through his lead counsel Tan Sri Muhammad Shafee Abdullah, filed an application at the Federal Court to adduce further evidence pertaining to his SRC case, in a bid to nullify his high court trial.

The Pekan MP alleged a massive conflict of interest involving the presiding judge then, Datuk Mohd Nazlan Mohd Ghazali. 

In a press conference, Shafee had said the application is aimed primarily at persuading the supreme court to invalidate the trial in the lower court, saying it has infringed the rules against bias and fair trial principles. 

Among other allegations, Shafee said Nazlan had wilfully failed to disclose his role, involvement, or knowledge in the setting up of SRC International. 

Najib was sentenced to 12 years jail and fined RM210 million by Nazlan in July 2020 after he was found guilty of all seven charges related to the misappropriation of RM42 million of SRC funds. 

Last December, the Court of Appeal upheld the high court judge’s conviction after finding that the guilty sentence delivered was correct, given the prosecution has proven elements of the offences beyond a reasonable doubt.

Nazlan recently found himself under investigation by the Malaysian Anti-Corruption Commission over allegations of unexplained money in his personal account. – The Vibes, July 8, 2022
