PUTRAJAYA – The Court of Appeal, here, has set August 30 for case management following the appeal by six individuals who were sentenced to death for the murder of deputy public prosecutor Datuk Anthony Kevin Morais, nearly six years ago.
Counsel Datuk N. Sivananthan who is representing former pathologist Dr R. Kunaseegaran told The Vibes’ sister portal Getaran of the development following the case management session before deputy registrar Mohd Fuad Abdul Aziz.
He said the defence counsel for the remaining five individuals had successfully filed their petitions after the record for appeal had been finalised.
However, Sivananthan said the Court of Appeal was unable to set a hearing date as the record of appeal would be published again.
“For today’s case management, all defence counsels confirmed that they have agreed with the notice of proceeding with each having filed a petition of appeal respectively.
“The issue that remains is only for the high court to not reprint the appeal record for amendments,” he said.
As per the records, he said, this is the ninth time that case management has been set for the case appeal.
On July 10, 2020, Kunaseegaran, money lender S. Ravi Chandaran and four unemployed individuals, namely R. Dinishwaran, A.K. Thinesh Kumar, M. Vishwanath, and S. Nimalan were each sentenced to death by the Kuala Lumpur High Court after being found guilty for murdering Morais.
Judge Datuk Azman Abdullah had ruled that all accused had jointly intended to murder the 55-year-old on 2015.
He said the prosecution had succeeded in proving the case beyond a reasonable doubt on the charge of murder with intent by Kunaseegaran and five other accused.
All six were accused of killing Morais when the deputy public prosecutor was driving on his way from Jalan Dutamas Raya, in Kuala Lumpur to Number 1 Jalan USJ1/6D, Subang Jaya, between 7am and 8pm, on September 4, 2015.
The case was pursued in accordance with Section 302 of the Penal Code read in conjunction with Section 34 of the same code, which provides for a mandatory death sentence upon conviction.
The body of the late Morais was discovered in a concrete drum five years ago, in what is considered one of the most high-profile murder cases in Malaysia. – The Vibes, July 22, 2022.
