SEREMBAN – A former soldier was sentenced to death by the high court here today for killing his daughter about five years ago.

Judge Rohani Ismail found Mohammad Abdullah Mohamed, 41, guilty of the offence after the defence failed to raise a reasonable doubt at the end of their case.

The accused was found guilty under Section 302 of the Penal Code, which carries a death sentence or imprisonment not less than 30 to 50 years and a minimum of 12 strokes of whipping.

“The court has heard and considered all arguments by the defence and prosecution and hereby sentences the accused to death,” said judge Rohani.

“Where you are ordered to be hanged to death will be determined later. The defence had only highlighted mere denials and assumptions.”

According to the charge sheet, Abdullah had caused the death of Nur Aina Nabihah Mohammad Abdullah, who was aged nine at the time of the offence on January 31, 2018, at 11.30pm at her home in Jalan Vista Jaya 5, Taman Vista Jaya, Lukut, Port Dickson.

Prosecution was carried out in accordance with Section 302 of the Penal Code and read together with Section 34 of the same code, which provides for the mandatory death sentence upon conviction.

Earlier, the accused’s lawyers, in their appeal, said their client had served in the army for 17 years and regretted and was sorry for what he had done.

He appealed for a jail sentence from the date of his arrest on January 31, 2018.

However, the prosecution asked the court to consider that the victim was the accused’s own child.

“There were 32 external and various other internal injuries on the victim. The accused had acted violently and stepped and kicked the victim to death without any mercy as a father.

“We appeal for a heavy sentence to be imposed in consideration of the severity of the offence,” said the prosecution.

The prosecution was by deputy public prosecutors Sharifah Maleeha Syed Hussin and Ala’uddin Baharom, while the accused was represented by two lawyers. – The Vibes, August 22, 2023
