DATUK Seri Mohd Rafizi Ramli (PH-Pandan) said that 10 PKR MPs may reject or abstain during the voting process for the Constitution (Amendment) Bill (No.2) 2026, if all the recommendations for improving the proposed act are rejected by the government.
He said the decision of the group of elected representatives would, however, be finalised after considering the findings of the Cabinet meeting to be held this Friday.
Apart from the decision of the Cabinet meeting, the former PKR Deputy President said that the views and recommendations submitted by Pakatan Harapan (PH) and Perikatan Nasional (PN) MPs would also be examined before further decisions were finalised.
"If the government insists (rejecting all the proposed improvements to the bill), then we have to make a decision... and because this requires a two-thirds majority, the government needs to consider it carefully.
"The last thing that the government wants is to push us to the wall,” he said at a press conference in Parliament today.
The Constitution (Amendment) Bill (No. 2) 2026 to appoint Public Prosecutors was tabled for the first reading in the Dewan Rakyat after eight years of being promised in the Pakatan Harapan (PH) manifesto for the 14th General Election (GE14).
This is in line with the separation of the role of the Public Prosecutor from the Attorney General to provide bail provisions for the Public Prosecutor, in addition to amending related matters involving both positions.
The proposed act, which will be enforced when approved by Parliament, sees the Prime Minister not having any role in the appointment process of the Public Prosecutor.
The appointment instead depends entirely on the discretion of the Yang di-Pertuan Agong after being nominated by the Judicial and Legal Services Commission (SPKP) and approved by the Conference of Rulers.
Rafizi added that the government needs to take the improvement recommendations seriously, as10 Members of Parliament or about a third of the total 31 PKR Members of Parliament, is not small.
"We have voiced (our views) well, but they have not been taken into account at all, let alone this proposal, which is not unreasonable.
"The number of 10 (MPs) from PKR alone is large. So, we are waiting for the Cabinet meeting and the developments after that, besides taking into account the views of other parties," he said.
Apart from Rafizi, the group consists of Wong Chen (Subang), Rodziah Ismail (Ampang), Nik Nazmi Nik Ahmad (Setiawangsa), Lee Chean Chung (Petaling Jaya), S Kesavan (Sungai Siput), Zahir Hassan (Wangsa Maju), Datuk Muhammad Bakhtiar Wan Chik (Balik Pulau), Onn Abu Bakar (Batu Pahat) and Hassan Karim (Pasir Gudang).
Earlier, Rafizi said that the Bill should be referred to the Parliamentary Special Select Committee (Human Rights, Elections and Institutional Reform), in line with the spirit of the separation of powers between the Executive and Legislative branches.
This is because, he said, the committee needs to obtain feedback and cross-party positions from members of Parliament to improve the proposed amendment to the existing Constitution.
He also wants the function of Parliament to be included in the appointment process of Public Prosecutors, with candidates who pass the vetting process having to be voted on in the Dewan Rakyat before being appointed by the Yang di-Pertuan Agong. – February 24, 2026
