JOHOR BARU – An 18-year-old man escaped caning for setting a dog on fire after the high court here reversed a sessions court decision.
According to The Star’s report, Braden Yap Hong Sheng was previously sentenced by the sessions court on April 19 to seven light strokes of the cane and a one-year good behaviour bond with a surety of RM10,000.
The caning was supposed to take place in open court today.
High court judge Datuk Abu Bakar Katar reversed the light caning sentence and maintained only the good behaviour bond.
Section 293(1)(c) of the Criminal Procedure Code (CPC) allows for not more than seven strokes of caning with a light cane on a male offender within the court premises in the presence of a parent or guardian.
The high court today agreed with Yap’s lawyer G.K. Sritharan, who argued that two sentences could not be given under Section 293 of the CPC.
Yap pleaded guilty on April 12 to the charge of causing excruciating pain to a brown female dog by beating it and setting it on fire at Taman Impian Emas on March 27. – The Vibes, May 21, 2023
