THAILAND’S Constitutional Court will rule on September 28 on whether the use of barcodes and QR codes on ballots in February’s general election violated the constitutional requirement for secret voting, in a case that could potentially force a fresh nationwide election and put Prime Minister Anutin Charnvirakul’s government in jeopardy.

The court accepted the case in March following 22 complaints referred by the Ombudsman, alleging that the ballot design could allow voters and their votes to be identified, compromising ballot secrecy. The court completed its examination of five witnesses in August and scheduled its verdict for September 28.

The case goes beyond the design of the ballot papers, as a ruling that the alleged violation was sufficiently serious to invalidate the election could trigger another nationwide poll.

An adverse ruling could leave Anutin’s administration operating as a caretaker government while a new election is held, potentially delaying major policy decisions and investment approvals.

The Election Commission has maintained that the barcodes and QR codes were intended to prevent fraud and ensure that ballot papers could be identified and counted.

It has acknowledged that, in theory, individual ballot papers could be matched with ballot stubs containing voter information, but said this could not happen in practice because the relevant records were kept separately.

Thai news agencies reported today that the court could also find that the ballot system had shortcomings without concluding that an actual violation occurred or that any breach was serious enough to invalidate the entire election.

Alternatively, the court could dismiss the case, removing the immediate legal challenge to the February election.

The Bhumjaithai Party, led by Anutin, won the February 8 election and subsequently formed the government. The election was held with more than 52.9 million eligible voters, with voters casting separate ballots for constituency and party-list MPs.

The court’s ruling comes as Thailand’s economy faces continued pressure, with high household debt and weak investment weighing on growth.

The prospect of another election would also reopen political competition only months after the February vote and could add to uncertainty in a country that has repeatedly experienced political disruption through court rulings, protests and military interventions.

Thailand’s Constitutional Court has previously annulled a national election. In 2006, it nullified an election amid concerns including ballot secrecy and other electoral violations. - September 25, 2026
