THE Ministry of Natural Resources and Environmental Sustainability (NRES) has refuted accusations made by Kedah Chief Minister Datuk Seri Muhammad Sanusi Md Nor that the Federal Government is deliberately stalling the development of rare earth element (REE) mining procedures to hinder the progress of SG4 states.
The claims, made in a Sinar Harian report dated 16 May 2025, suggested that the Federal Government had delayed the issuance of standard operating procedures (SOP) for REE mining, thereby obstructing the economic development of certain states.
In response, NRES has clarified that such allegations are baseless. "This matter was addressed publicly through a media statement dated 29 October 2024. The SOP for REE mining in Malaysia was completed and circulated to all State Governments via official correspondence dated 20 December 2023," said Minister Nik Nazmi Nik Ahmad.
The Ministry explained that the SOP includes comprehensive technical guidelines, environmental compliance requirements, mine site rehabilitation protocols, and regulations governing exports. It is a legally grounded reference framework meant to be adapted by individual states according to their respective legislative provisions.
“Any delays or constraints at the state level should not be attributed solely to the Federal Government,” the Ministry emphasised, adding that the SOP was designed to facilitate state-level implementation and is aligned with existing laws.
NRES also reiterated that REE mining is strictly prohibited in environmentally sensitive zones, including Permanent Forest Reserves (HSK), Environmentally Sensitive Areas (KSAS), and protected reserves. Mining in other areas may proceed, subject to full compliance with policies, acts, and established guidelines.
Regarding the Menteri Besar's assertion that no SOP exists for REE exploration activities, the Ministry clarified that exploration is under the jurisdiction of individual state governments. In Kedah, for instance, such activities fall under the Kedah Mineral Enactment 2004 and are regulated through Prospecting and Exploration Licences.
"It is inaccurate to suggest that no guidelines exist when the matter is already covered under state law," NRES stated.
The Ministry also dismissed the allegation that the Federal Government is deliberately obstructing Kedah's progress. "Such an accusation is wholly inaccurate. The Federal Government remains committed to ensuring that the development of the mineral sector is conducted responsibly and sustainably, not only for economic advancement but also for the well-being of future generations, regardless of state," the statement said.
Minister Nik Nazmi urged state leaders to base their statements on verified information and to refrain from politicising resource management issues.
"It is crucial that natural resource policies are not used as tools for political polemics. The people stand to benefit more from strong cooperation between Federal and State Governments in pursuing genuine progress," he said. - May 19, 2025
