DISAPPOINTMENT and sadness marked Nooryana Najwa Najib’s public response after the High Court rejected former prime minister Datuk Seri Najib Razak’s application to serve his prison sentence under house arrest, a decision that dashed hopes held by his family and supporters.
Better known as Yana, Najib’s daughter, took to Instagram on Monday to share her reaction, reposting several excerpts from the court’s judgment explaining why the alleged addendum permitting house arrest could not be accepted.
The ruling stated that the purported order attributed to the 16th Yang di-Pertuan Agong was invalid due to procedural shortcomings and non-compliance with the Federal Constitution.
One of the excerpts highlighted that the Yang di-Pertuan Agong is a constitutional monarch whose powers, including those relating to clemency, must be exercised in accordance with Article 42 of the Constitution.
The court found that the alleged addendum was neither deliberated nor approved during the 61st Federal Territories Pardons Board meeting, rendering it legally unenforceable.
Alongside the legal explanations, Yana posted a brief personal message acknowledging the unfavourable outcome and apologising to those who had been hoping for positive news.
“So sorry daddy. I can’t imagine how you must be feeling at this moment. Have lots of patience, okay? We live to fight another day, as always. Take care of your health daddy, that’s the most important thing,” she wrote.
She later reshared a news update confirming that Najib would remain incarcerated at Kajang Prison.
In the same post, Yana addressed her father directly, offering words of comfort, urging patience, and emphasising the importance of his health amid the ongoing legal battle.
“Sorry everyone, not good news today,’ she wrote.
Yesterday, Najib suffered a legal setback today as the High Court dismissed his application to serve the remainder of his six-year prison sentence under house arrest, compelling him to continue his incarceration at Kajang Prison.
High Court judge Alice Loke Yee Ching ruled that the add-on order, previously issued by the former Yang di-Pertuan Agong to permit Najib’s house arrest, is invalid and cannot be implemented.
The decision underscores that Najib must complete the remaining duration of his sentence in prison, reaffirming the court’s stance on the enforceability of custodial sentences.
The ruling also highlights the legal limitations surrounding any royal directives aimed at altering the conditions of imprisonment. – December 23, 2025
