THE government has issued a stern warning that there is no room for compromise against any individual who drives under the influence of alcohol or drugs following the fatal accident that claimed the life of Amirul Hafiz Omar on Jalan Raya Barat, Klang, yesterday.
Transport Minister Anthony Loke said the loss of life was heartbreaking and that the incident was not just an ordinary accident but a form of criminal negligence that was completely unacceptable.
According to him, the government views the incident seriously and has assured that strict action will be taken against the perpetrators if convicted.
“The government will not compromise against any individual who drives under the influence of alcohol or drugs, as it clearly endangers the lives of other road users,” he said in a statement today.
In the incident at about 11.40 am yesterday, the victim died after the motorcycle he was riding was hit by a car on Jalan Raya Barat.
South Klang District Police Chief Assistant Commissioner Lim Jit Huey reportedly said that the accident involved a motorcycle and two cars.
According to him, initial investigations found that a Honda City driven by a local man in his 20s was coming from the direction of Jalan Raya Barat towards Bandar Klang at a high speed and dangerously.
He said that the driver is believed to have overtaken several vehicles before entering the opposite lane and crashing into the victim's motorcycle, causing the victim to be thrown onto the car and die at the scene.
The driver involved is now being remanded for four days to assist in further investigations.
Commenting further, Loke said that amendments to the law relating to the offence of driving under the influence of alcohol and drugs have been passed in the Dewan Rakyat and have been in effect since October 2020, with harsher punishments for offenders.
According to Section 44 of the Road Transport Act 1987, individuals who drive under the influence of alcohol or drugs causing death can be sentenced to imprisonment for not less than 10 years and not more than 15 years and a fine of between RM50,000 and RM100,000 if convicted.
For repeat offences, a heavier punishment can be imposed, namely imprisonment of not less than 15 years and not more than 20 years and a fine of between RM100,000 and RM150,000.
Meanwhile, the Ministry of Transport (MOT) urged police to expedite a comprehensive investigation so that the investigation papers can be referred to the Attorney General's Chambers for prosecution, as well as hoping that the court will impose the heaviest sentence if the accused is found guilty.
