DATIN Seri Rosmah Mansor's appeal against her 2022 conviction and sentence in the graft case involving the solar hybrid project for 369 rural schools in Sarawak has been postponed once again.
A three-member bench chaired by Court of Appeal judge Datuk Azhahari Kamal Ramli allowed Rosmah’s application for an adjournment and fixed the appeal for Sept 1 to 4, Sept 8 to 11, and Sept 21 to 30.
Azhahari also stressed that since this is a 2022 case, the court will not compromise on the dates anymore.
“We are allowing her to exhaust all available legal avenues, including the review application,” he said.
The panel, also comprising Court of Appeal judges Datuk Dr Choo Kah Sing and Datuk K Muniandy, warned that the appeal must begin and conclude within that period.
Rosmah was represented by Datuk Jagjit Singh.
Jagjit applied for an adjournment so that Rosmah's review application, arising from her bid to recuse trial judge Datuk Mohamed Zaini Mazlan on the grounds of two draft notes, or a leaked "judgement", could be disposed of first.
This follows the Federal Court's decision, which had previously dismissed her application to remove Mohamed Zaini from conducting the trial at the Kuala Lumpur High Court.
On March 3, the Federal Court dismissed Rosmah's final appeal to remove Mohamed Zaini, who is now a Court of Appeal judge, after ruling that there was no error that warranted the court's intervention.
On September 1, 2022, Mohamed Zaini convicted Rosmah on three counts of corruption related to a solar hybrid project for 369 rural schools in Sarawak worth RM1.25 billion.
She was sentenced to 10 years in prison for each count and fined RM970 million.
The court also ordered Rosmah to serve an additional 10 years in prison if she fails to pay the fine.
However, the execution of the sentence has been postponed pending the decision of the appeal.
Rosmah was found guilty of soliciting a bribe of RM187.5 million from former Jepak Holdings Sdn Bhd Managing Director, Saidi Abang Samsudin, through her former assistant, Rizal Mansor, in return for helping the company obtain the project in question.
She was also convicted of receiving a bribe of RM5 million from Saidi through Rizal in Seri Perdana, Putrajaya, on December 20, 2016, as well as RM1.5 million at his residence in Jalan Langgak Duta on September 7, 2017. - July 1, 2026
