KUALA LUMPUR – The court handed a bankruptcy order against Jaringan Melayu Malaysia (JMM) president Datuk Azwanddin Hamzah.

The defamation suit brought by Seputeh MP Teresa Kok, which began in January 2019, was settled out of court, and a consent judgement recorded by high court judge Rohani Ismail.

“However, Datuk Azwanddin has failed to honour the consent judgment and has failed to make any payment of the settlement sum to date,” Kok said in a Facebook post.

She said her lawyer was instructed to then initiate bankruptcy proceedings against Azwanddin at the Shah Alam High Court.

“Subsequently on March 29, a bankruptcy order was granted against Datuk Azwanddin by the court,” she said.

A bankruptcy order is understood to be the final order given by the court in successful bankruptcy proceedings.

This would mean, should such an order be awarded, the person who the proceedings are filed against would be declared bankrupt.

“On the request of judgment creditor Teresa Kok and after reading the creditor’s petition on September 17, 2020...and the absence of the judgment debtor (Azwanddin), it is clear to the court that an act of bankruptcy has been committed,” the judgment shared by Teresa read.

The court ruled that Azwanddin failed to comply with the requirements of the bankruptcy notice dated July 8 that was served on him on August 12.

Section 3(1)(i) of the Insolvency Act states that  failure to pay amounts stated in a bankruptcy notice within seven days of receiving the notice would amount to an act of bankruptcy.
