ALOR STAR – The high court here today fixed December 21 for the proprietor of Nasi Kandar Salleh in Napoh, Kubang Pasu, who was the index case in the Sivagangga cluster, to file his defence in a suit brought by the Kedah Consumers’ Association (Cake).
The group’s lawyer, Mohammad Zunun Baihakky, said he has received a letter from the counsel representing Nezar Mohamed Sabur Batcha seeking a date to file the said defence.
“The court has set December 21 for his (Nezar’s) lawyer to file the defence. If no defence is filed on that day, we will apply to the court for a judgment in default against him,” he told reporters after case management, which was also attended by Cake secretary Mohd Yusrizal Yusoff.
On August 13, Nezar was sentenced to five months’ jail and fined RM12,000 by the magistrates’ court after he pleaded guilty to four charges of breaching his Covid-19 quarantine on July 14.
Cake, on behalf of some 200 traders and workers in Napoh whose incomes were affected by the resultant outbreak, filed a RM1.5 million suit against Nezar on August 19.
Zunun said Nezar was released from prison on Tuesday. – Bernama, November 29, 2020
