AGC to advise on Mohd Shuhaily’s AKPS contract before any termination decision
IGP says the matter would be returned to PDRM for follow-up action once the legal process and the process of obtaining the King’s consent is completed - October 28, 2026

THE Attorney-General’s Chambers (AGC) has been asked to advise on the service status of Datuk Seri Mohd Shuhaily Mohd Zain at the Malaysian Border Control and Protection Agency (AKPS) before any decision to terminate or shorten his tenure is submitted for His Majesty, the King's consent.

Inspector-General of Police Tan Sri Mohd Khalid Ismail said the matter had also been referred to the Police Force Commission for further action.

He said legal advice was necessary because Mohd Shuhaily’s assignment to AKPS was based on a two-year secondment contract from the Royal Malaysia Police (PDRM), which had received the King’s consent.

“We are referring the matter to the AGC because Datuk Seri Mohd Shuhaily’s assignment to AKPS is for a period of two years,” he said.

“As it is a contract made with the consent of the King of Malaysia, if any action is taken, including suspension from duty, we will depend on the AGC’s advice. Any decision involving termination of the contract must also be submitted to the King for consent,” he added.

Mohd Khalid said the legal advice would ensure that any action taken complied with the terms of the contract and the requirements governing the King’s consent.

He said the matter would be returned to PDRM for follow-up action once the legal process and the process of obtaining the King’s consent had been completed.

“Datuk Seri Mohd Shuhaily is still a serving police officer. Once the matter is returned to PDRM, I may provide further details on the action to be taken,” he said.

Mohd Khalid was speaking after the 2026 National Conference on Bureaucratic Reform organised by the Malaysia Productivity Corporation (MPC) in Kuala Lumpur today. - October 28, 2026
